These terms govern your use of the Modern Black Art website at modernblackart.com and any membership you take out with us. By signing up, browsing the site or making a donation, you agree to these terms. If you don’t agree, please don’t use the site.
1. Who we are
Modern Black Art is a membership community for collectors, artists and art lovers. We are based in the United Kingdom. You can contact us at hello@modernblackart.com.
2. Membership
Membership is free. By signing up you agree to receive occasional emails about our events and a monthly newsletter. You can unsubscribe at any time using the link at the bottom of any email.
We may invite members to events with limited capacity. Receiving an invitation does not guarantee a place. Some events may have specific eligibility criteria; we’ll always tell you what they are before you sign up.
We reserve the right to suspend or remove any member whose conduct, in our reasonable judgement, is harmful to the community or to our partners and artists.
3. Donations
Donations are voluntary and are processed by Stripe. By making a donation you confirm that the payment method belongs to you and that you are authorised to use it.
Donations are non-refundable except where required by law. If you believe a donation was made in error, please contact us within 14 days and we’ll consider the request in good faith.
4. Intellectual property
All content on this site — including writing, photography, artwork, the Modern Black Art name and logo — is owned by us or used under licence from the artists and contributors involved. You may not copy, reproduce or distribute any of it without our written permission.
Artists whose work appears on the site retain all rights in their work.
5. Acceptable use
You agree not to use the site to send spam, harvest personal data, impersonate anyone, post unlawful content or interfere with the site’s normal operation.
6. Limitation of liability
We provide the site and our communications “as is”. We don’t guarantee that the site will always be available or error-free. To the fullest extent permitted by law, we are not liable for any indirect or consequential losses arising from your use of the site or our events. Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for fraud.
7. Changes to these terms
We may update these terms from time to time. If we make material changes we’ll let members know by email or by a notice on the site. The “Last updated” date at the top of this page shows the most recent revision.
8. Governing law
These terms are governed by the laws of England and Wales. Any dispute will be subject to the exclusive jurisdiction of the courts of England and Wales.
